SPECIFIC VAT CHALLENGES & OFFICIAL REGULATIONS

4 Typical VAT Challenges
for Engineering & Architecture Consultants.

Engineering and architectural consultants navigate multi-month service contracts, milestone billings based on drawings/reports, and Article 23 income tax withholdings. Here are 4 typical consultant VAT challenges and their official legal bases:

01

Tax Points for Consulting Services: Retainers vs Progress BAST Milestones

Architectural and engineering contracts are billed in stages: mobilization advance, schematic design, detailed engineering design (DED), and periodic site supervision. Under VAT Law Article 13(1a) and PER-11/PJ/2025 Article 31(2), Tax Invoices must be issued upon advance payment or when progress acceptance certificates (BAST) are approved, whichever comes first. Coretax e-Faktur approval must conclude before the 20th of the following month to avoid the 1% tax base penalty (HPP Law / KUP Article 14(4)). Neracia aligns BAST dates with prompt e-Faktur drafts.

02

Government & SOE Consulting Projects: WAPU Withholding Codes 02 & 03

Engineering consultants frequently design public facilities for ministries/departments (Public Works) and state-owned developers. Under PMK No. 59/PMK.03/2022 and PMK No. 8/PMK.03/2021, services rendered to government entities undergo VAT withholding by official treasurers (code 02) or SOEs (code 03). Withheld VAT is not paid out-of-pocket by the consultant, but must be reported on the Coretax VAT Return. Selecting the wrong transaction code delays disbursement or skews tax balances. Neracia maps WAPU transaction codes with precision.

03

Article 23 Withholding Tax (2%) vs Gross VAT Tax Base (DPP)

Consulting engineering and architectural services undergo a 2% Article 23 income tax withholding on gross fees excluding VAT (Income Tax Law Article 23 and PMK 141/PMK.03/2015). Corporate clients routinely transfer net fees after withholding this 2%. However, the VAT Tax Base (DPP) must strictly remain the gross service value before income tax withholding (VAT Law Article 1(17)). Neracia reconciles gross invoices, client e-Bupot 23 slips, and Coretax e-Faktur tax bases to eliminate turnover discrepancies upon return filing.

04

Validating Input VAT from Architectural Software (BIM/CAD), Sub-consultants & Studio

Consultancies subscribe to specialized design software (AutoCAD, Revit, SketchUp), hire geotechnical/MEP sub-consultants, and lease studio space. Domestic vendor input invoices must be verified against 16-digit NPWPs and consultant branch NITKUs in Coretax before the 20th to secure statutory crediting rights under VAT Law Article 9 and PMK 81/2024. Neracia compiles structured input invoice reconciliation workpapers so eligible operational expenses offset payable VAT balances to the fullest statutory extent.

FICTITIOUS SIMULATION · SYNTHETIC DATA

Fictitious Engineering & Architectural Consulting VAT Simulation

Synthetic simulation of private residential DED milestone billing, government building WAPU planning tender, soil study advance, and architectural software input VAT. The 12% × 11/12 VAT figures represent the mathematical Coretax illustration.

For supplies other than luxury goods subject to luxury-goods sales tax, the VAT figures in the table are a 12% rate times an other-value base. That base is 11/12 of the selling price or service consideration (PMK 131/2024 Article 3). Fictitious example: 12% × (11/12 × IDR 40,000,000) = IDR 4,400,000. A figure equal to 11% of the base column is the result of that formula. Specific amounts and separately regulated other values do not use this formula (PMK 131/2024 Article 4).

FREQUENTLY ASKED QUESTIONS · CORETAX VAT

Frequently Asked Questions
for Engineering & Architecture Consultants.

Practical answers on Coretax e-Faktur compliance and the draft-only workflow for this sector:

When must consultant Tax Invoices be issued if progress payments await client verification?

Under VAT Law Article 13(1a) and PER-11/PJ/2025 Article 31(2), Tax Invoices must be issued upon delivery of a service stage (the date the milestone BAST is approved) or upon receiving payment, whichever occurs first. Delaying invoice issuance until clients eventually transfer deferred payments risks a 1% tax base late penalty.

Reference: VAT Law Article 13(1a), read with PER-11/PJ/2025 Article 31(2)

How is VAT handled for ministry or local government planning projects (WAPU)?

For government agency projects, consultants issue e-Faktur with transaction code 02 (PMK 59/2022). VAT is not paid out-of-pocket by the consultant; it is withheld directly by the government treasurer. The consultant must still report the invoice on the Coretax VAT Return, cross-referencing payment orders (SPM) or state receipt numbers (BPN).

Reference: PMK No. 59/PMK.03/2022 Article 3 and Article 18

Why is the VAT base calculated on gross billings when clients withhold 2% Article 23 income tax?

Under VAT Law Article 1(17), the VAT Tax Base (DPP) is the agreed gross consideration for service delivery. The 2% Article 23 withholding tax represents an income tax obligation creditable against annual corporate income tax, and cannot lawfully reduce the gross VAT invoice base.
